What is earned wage access?

By Ben Tabas, Intrica Research · Updated · US

Answer

Earned wage access (EWA) lets a worker draw pay they have already earned before the scheduled payday. A CFPB advisory opinion published Dec. 23, 2025 says EWA repaid by payroll deduction, capped at accrued wages, with no recourse and no credit check, is not credit under the Truth in Lending Act. That was still the federal position when we checked on Oct. 28, 2026.

Federal status as of Oct. 28, 2026

  • The CFPB's Dec. 23, 2025 advisory opinion treats covered EWA as outside Regulation Z. Morrison Foerster's Jan. 7, 2026 summary lists the conditions: payroll deduction repayment, advances no larger than accrued wages, no recourse beyond the deduction, no collections or credit reporting, and no credit underwriting.
  • Under the same opinion, expedited delivery fees and voluntary tips in a covered program are not finance charges. Morrison Foerster notes tips can count as finance charges if they are hard to decline.
  • The opinion rescinded the CFPB's July 2024 proposed interpretive rule, which would have treated EWA as credit.
  • Congress has a bill pending. H.R. 9330, the Earned Wage Access Consumer Protection Act, was ordered reported 29 to 22 by the House Financial Services Committee on June 30, 2026 and placed on the Union Calendar on Sept. 1, 2026. It had no floor vote as of Oct. 28, 2026.
  • As summarized by Orrick on July 10, 2026, the bill would require a provider that charges a fee for early access to offer the same amount at no cost, and would bar late fees, interest and credit reporting.

State rules

States regulate EWA separately from the CFPB. McGuireWoods counted EWA laws in Arkansas, Indiana, Kansas, Maryland, Missouri, Nevada, South Carolina, Utah and Wisconsin as of May 28, 2025.

Indiana's law, effective Jan. 1, 2026 per McGuireWoods, requires a state license and at least one no-cost option. California's DFPI regulates EWA through its own rulemaking, according to Morrison Foerster.

What an EWA provider checks before launch

  1. Map the product against the CFPB's covered EWA conditions, starting with how repayment works.
  2. List every state you serve and confirm license, registration and fee disclosure rules in each.
  3. Make the free delivery option easy to find and make tips easy to decline.
  4. Recheck federal and state status before each product change, since H.R. 9330 and state bills were still moving in 2026.
